These Terms for AI Coach (“Terms”) are an integral part of Heartify Terms of Use incorporated herein by reference. In case of any controversy regarding the subject of these Terms, these Terms shall prevail.
Please read these Terms carefully before you use the AI Coach functionality. The Terms govern relations between you as an end-user (“you”) and Heartify LLC (“Heartify”, “we”, “us”, “our”) when you access and use the AI Coach (“Chatbot”).
We developed our Chatbot with the use of ChatGPT API owned by OpenAI, L.L.C. (“OpenAI”). The technologies used in the Chatbot are proprietary and subject to their owners` licenses. You are not allowed to extract, disassemble, modify, or use the Chatbot in any way not directly permitted in these Terms or in instructions included in the Chatbot from time to time. You must also comply with the OpenAI`s restrictions for ChatGPT use.

You are not allowed to extract, disassemble, modify, or use the Chatbot in any way not directly permitted in these Terms or in instructions included in the Chatbot from time to time. You must also comply with the OpenAI`s restrictions for ChatGPT use.
Our Chatbot is powered by OpenAI artificial intelligence technologies. This means that Chatbot does not involve or imply any direct human engagement when processing your requests (“input”). Therefore, the results of such processing (the “output”) are also entirely free of human presence. Learn more about the main features of ChatGPT AI technology here.
Due to the specifics of the Chatbot, the following volume limitations apply:
From time to time, other limitations may apply. We will try to notify you about them, but we cannot guarantee timely and proper informing you on changes, as they are not always under our control and may occur on OpenAI`s side.
Due to the specifics of the Chatbot, the following volume limitations apply:
- All users are limited to 12000 tokens (about 48000 characters) per day;
- Users that use Heartify App for free are limited to 3 messages in the Chatbot per day.
From time to time, other limitations may apply. We will try to notify you about them, but we cannot guarantee timely and proper informing you on changes, as they are not always under our control and may occur on OpenAI`s side.
The Chatbot is not designed for medical use. You should not seek medical or professional health advice from it. You should not also try to use it for diagnosing or treatment of any health condition. You may use the Chatbot to obtain general information on wellness and well-being only.
The Chatbot should not be used to triage or manage life-threatening issues that need immediate attention.
The Chatbot as well as the Heartify App is not intended for use by minors under 18 and is forbidden for use by children under 13.
You may not use the Chatbot in a way that infringes, misappropriates, or violates any person’s rights.
You may use the Chatbot for your personal, non-commercial purposes only. You may not use the Chatbot to provide any kind of services or advice. However, you own the input and the output, and you may use them as you wish if such use does not violate the law or other people`s rights.
We may, at our sole discretion and for any reason, at any time discontinue the Chatbot in the App.

If for some reason you deem it safe to share your personal data with the Chatbot, here you can find more information about how OpenAI deals with the personal data you input for further processing. Heartify has no access to the information you input in the Chatbot.
We do not share your personal data with OpenAI or other third parties without your explicit consent or under another relevant lawful basis according to applicable data protection law.

As the owner of API states, “the ChatGPT is not connected to the internet, and it can occasionally produce incorrect answers. It has limited knowledge of world and events after 2021 and may also occasionally produce harmful instructions or biased content.” We do not have any control over the AI technology integrated into our Chatbot. We are not responsible for the process and the output of AI operation as a part of our Chatbot.
Heartify disclaims any responsibility for the accuracy, correctness, and non-harmful nature of the output you receive as a result of your request to the Chatbot. If you decide to apply the output, you agree that you do this at your sole risk.
THE CHATBOT IS PROVIDED “AS IS”, AND “AS AVAILABLE”. WE DO NOT MAKE ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, WITH REGARD TO THE MERCHANTABILITY, TECHNICAL COMPATIBILITY TITLE, NON-INFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE OF ANY OUTPUT OR MATERIAL PROVIDED BY THE CHATBOT, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED, SAVE TO THE EXTENT REQUIRED BY LAW. NEITHER HEARTIFY LLC, NOR ANY OF ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, REPRESENTATIVES, SUPPLIERS, PARTNERS, ADVERTISERS OR CONTENT PROVIDERS WARRANTS, AND EACH OF THEM HEREBY EXPRESSLY DISCLAIMS, THAT: (A) THE CHATBOT WILL BE SECURE OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) ANY CONTENT AVAILABLE AT OR THROUGH THE CHATBOT IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (D) THE RESULTS OF USING THE CHATBOT WILL MEET YOUR REQUIREMENTS, OR (E) THE ACCURACY, RELIABILITY, OR COMPLETENESS OF THE CONTENT, TEXT, IMAGES OR COMMUNICATIONS PROVIDED THROUGH THE CHATBOT. SOME STATES / COUNTRIES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Other limitations of liability and disclaimers specified in Heartify Terms of Use are incorporated herein by reference and apply to the maximum possible extent.
Notwithstanding the above, under no circumstances will we be liable for any adverse consequences of your use of the Chatbot.
Our authorized personnel may access the history of your chat to fulfill our legal and contract obligations, monitor and prevent illegal activity and improve our services. For these purposes only, we may also implement automation instruments, including those of third-party service providers. In this case, we will take reasonable measures to ensure your data is safe and secure. We will not sell any of your data or inputs in the chat or share them for other purposes than stated above and outlined in our Privacy Policy.
Heartify disclaims any responsibility for the accuracy, correctness, and non-harmful nature of the output you receive as a result of your request to the Chatbot. If you decide to apply the output, you agree that you do this at your sole risk.
